IMPORTANT Terms, Conditions and Privacy Policy of doubleAds.com PLEASE READ THE ENTIRE MEMBERSHIP AGREEMENT BELOW, INCLUDING OUR PRIVACY POLICY.
This Membership Agreement ("Agreement") between you ("You" or "Member") and doubleAds.com, and its affiliated entities (collectively referred to herein as "doubleAds.com" or "We" or "doubleAds" or "doubleAds Network"), sets out the terms of your membership in doubleAds.com. Affiliated entities shall mean any company or other legal entity directly or indirectly owned by, controlled by or under common control with doubleAds.com.
This service is provided to the member of the community the following Terms of Service and any operating rules or policies that may be published by doubleAds.com. The Terms of Service comprise the entire agreement between Member and doubleAds.com and supersede all prior agreements between the parties, regarding the subject matter contained herein. By participating in the registration process, members are indicating their agreement to be bound by all of these Terms of Service.
doubleAds.com is providing member with the capabilities of increasing personal website traffic in exchange for advertising revenues, and increasing other web developer's website traffic. doubleAds.com collects online behavior statistical information for our members. Examples of information that we collect, other than through the registration form, include URL of visited pages, registration for offerings and IP addresses. Upon termination of the online session, closing of the browser and/or termination of your membership, this information will no longer be collected. We gather this information to improve the administration of the services and to increase the overall security and integrity of the doubleAds.com system. doubleAds.com retains the right to terminate Member’s membership and rights to use the Service. Termination may happen for any reason, however is generally associated with violating the terms of service that doubleAds.com has set out.
doubleAds.com may change these Terms of Service from time to time. Upon any change in these Terms of Service, doubleAds.com is not responsible for notifying any user of these changes as we find it the responsibility of the user to be aware of the community rules at all times. Member’s continue usage of doubleAds.com is subject to following these terms, failure to comply will result in immediate removal.
This Agreement may be modified by doubleAds.com from time to time, with or without notice. Member accepts any modification by using the Service after the modifications have become effective. If the Member objects to any modification, the Member’s sole remedy is termination of the Member’s account by contacting our support staff.. doubleAds.com will post any modification and its effective date on this page.
To maintain a Membership with doubleAds.com, You must meet the following requirements and doubleAds.com reserves the right to terminate the Membership of anyone who fails to meet these requirements on an ongoing basis:
You may only sign up once and maintain one Membership. Only one individual per account. Only one account per e-mail address. Only one account per individual. Only one account per computer. Any duplicate accounts are subject to cancellation with forfeiture of all credits and referrals held in such accounts. No transfer of any credits or referrals between accounts or to any third party, credits and referrals cannot be transferred by Member upon death, as part of a domestic relations matter or otherwise by operation of law
You must provide doubleAds.com with valid contact (email address) information and may not impersonate or misrepresent Your identity. doubleAds.com reserves its rights under the laws to terminate your account, and associated membership, containing untruthful information for which You are responsible; doubleAds.com may request from time to time that you update the information on your online registration. doubleAds.com may terminate your membership and close your account if you fail to update your information upon request from doubleAds.com.
Your User name/MemberID, password, and account are personal to you and are not transferable; You may not allow anyone else to use Your password or account; You may not use anyone else's password or account. You are responsible for keeping Your password secret; doubleAds.com is not liable for any loss or damages caused by any disclosure of your password or account; You may only create an account for yourself and may not establish an account on behalf of anyone else.
You may cancel Your Membership by contacting our support team. If you decide to cancel Your membership and later wish to re-enroll, You will be assigned a new account, and You will not receive further credit for referrals made using Your previous account.
To the full extent allowed by applicable law, doubleAds.com at its sole discretion and for any or no reason may refuse to accept applications for membership and may terminate any Members without prior notice for good cause, particularly including, but not limited to: (a) any violation of any provision of this Membership Agreement; (b) aiding in or promoting circumvention of the Service; (c) acting against the business interests or reputation of doubleAds.com; (d) otherwise acting in a severely or substantially unlawful manner in relationship to doubleAds.com, the doubleAds.com Web site or the Service; (e) material breach of our spamming policy; or (f) any other reason at the discretion of doubleAds.com;
Member acknowledges and agrees that doubleAds.com neither endorses the contents of any Member sites or pages nor assumes responsibility for any threatening, libelous, obscene, harassing or offensive material contained therein, any infringement of third party intellectual property rights arising therefrom or any crime facilitated thereby.
Member is entirely responsible for the maintenance and the confidentiality of his/her Member login name and password. In cases where users loose/forget their password we ask that you Click Here and enter your username. If you forget your username Contact Us and request your username.
Credits may be earned only in compliance with this agreement and other regulations posted on the doubleAds web site. In general, a credit may only be earned through our doubleAds software/website, when a member introduces another member to the doubleAds service or any other method that doubleAds creates.
The doubleAds Network maintains ownership and all right to the doubleAds name, logo, databases, web site, information, software and site graphics. The member may under no conditions use or modify any copyrighted material in ways not stated in these terms and conditions. Any material owned or created by doubleAds may be used only to promote the member's site or refer new members to the doubleAds web site.
No member shall be required to pay any dues to maintain an active doubleAds registration. If the member chooses to participate in optional fee-based services, the membership fee must be paid in advance to maintain continuous service.
PRO member will earn the commission when any of your downline upgrade to
PRO Member.
PRO member will earn advertise commmission, when any of your downline purchase our advertising package.
A member may not artificially inflate traffic counts, credits, click counters counters using any device, program robot or other means. The doubleAds Network will immediately terminate, without obligation to redeem outstanding credit balances, the membership of any member that does not comply with all terms of this agreement, provides innacurate or dishonest information for fraudulent purposes, or is found linking to or promoting the doubleAds network in newsgroups, bulk e-mail, chatrooms, or guestbooks. No credits or other account balances may be redeemed after an account is closed, regardless of the reason for closure.
Member is solely and fully responsible for the contents of his/her transmissions through the Service. Members use of the Service is subject to all applicable local, state, and international laws and regulations. Member agrees to:
1 ) That he/she will not use any mechanical devices to attempt to automate the usage of doubleAds.com. (e.g. automated software, macros, emmulators, auto-refreshers, auto-download tool and etc.). Such action will result in immediate termination.
2 ) That he/she will place no more than 1 pop-up window on his/her site. This is included but not limited to interstitials, superstitials, exit window, exit consules.
3 ) That he/she will create/provide such a website that does not destory/break the doubleAds.com navigation page OR website in such a way to disturb other user's abilities to use doubleAds.com (e.g. "frame busters", "Virus Affected", etc.).
4) That he/she will not promote any site within doubleAds.com that contains adult materials, porno, profanities, hate material, any other unsuitalbe websites or anything of a similar nature.
5) That he/she will not use any means of spam to generate additional referrals. doubleAds.com is not legally responsible for any such activities, and will seek to prosecute any such individuals that use spam to promote doubleAds.com.
6) That he/she will monitor a valid email address which can be updated at anytime inside the member's area. If email bounces for any reason more than three times, including a full email box, we will delete the member's account.
SERVICE IS DEEMED ACCEPTED BY MEMBER. THE SERVICE IS PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, doubleAds.com FURTHER DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE PRODUCT, doubleAds.com MAKES NO WARRANTY THAT THE SERVICE WILL MEET MEMBER’S REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; doubleAds.com DOES NOT PROVIDE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT DEFECTS IN THE SOFTWARE OR SERVICE WILL BE CORRECTED. doubleAds.com MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICE. IN NO EVENT SHALL doubleAds.com OR ITS BUSINESS PARTNERS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES, LOST REVENUE, PROFIT OR DATA, OR FOR DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES) ARISING OUT OF THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE PRODUCT, EVEN IF doubleAds.com HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO MEMBER.
The member agrees to participate in the doubleAds Network at his/her own risk and agrees NOT to hold doubleAds, its administrators, partners, employees, or sponsors liable for any damage or loss of information that may occur from the use of doubleAds services. The member agrees to defend, indemnify and hold the doubleAds Network harmless from and against any and all claims, losses, liability costs and expenses (including but not limited to attorneys' fees) arising from the member's violation of this Agreement or any third-party's rights, including but not limited to infringement of any copyright, violation of any proprietary right and invasion of any privacy rights. This obligation will survive any termination of this Agreement.
Your relationship to doubleAdscom is one of an independent contractor and/or customer. No employee-employer relationship is created by your use of the Service. You do not have any obligation to refer new members to the doubleAdscom. Program. doubleAdscom HAS NO OBLIGATION TO OFFER THE SERVICE OR OTHER PROMOTIONS TO YOU.
doubleAds.com shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the service, or for cost of procurement of substitute goods and services, or resulting from any goods or services purchased or obtained, or messages received or transactions entered into through the service or resulting from unauthorized access to, or alteration of member's transmissions or data, including but not limited to, damages for loss, profits, use, data or other intangible assets.
All parts of doubleAds.com are copyrighted materials. Any usage of such intelectual property shall result in immediate action on part of doubleAds.com.
doubleAds.com soley makes no guarantee on the quality of advertising forth coming from credits or banner impressions or email ads. doubleAds.com remains a strict NO REFUND policy other than the 90-day money back guarantee for Pro membership as stated on the website. If a member is deleted for any reason during the first 90 days the 90-day money back guarantee will be considered null and void as well. Any person/organization purchasing advertising hereby forfeits any and all legal rights to doubleAds.com. By joining doubleAds.com (and purchasing from doubleAds.com) you agree to not take any legal action for any reason against doubleAds.com or any of its subsidaries. Essentially this means doubleAds.com is not legally responsible for any loss you may incurr as a result of making a purchase from doubleAds.com. These terms of condition are binding on all parties whether known or not since all parties agree to the doubleAds.com terms of condition upon joining.
Member agrees to indemnify and hold doubleAds.com, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of Member’s use of the Service, the violation of these Terms of Service by Member, or the infringement by Member, or other user of the Service using Member’s computer, of any intellectual property or other right of any person or entity.
If Member objects to any of these Terms of Service or any subsequent modifications thereto or becomes dissatisfied with the Service in any way, Member’s only recourse is to immediately: (1) discontinue use of the Service; and (2) terminate Service membership.
